Terms of service

These Terms of Service (“Terms”) constitute a legally binding agreement between WineFairy Deluxe Tasting (“WineFairy”, “we”, “us”, or “our”) and the client (“Client”, “you”, or “your”) booking a mobile tasting event. By engaging our services, you acknowledge and agree to the following terms.

 

 


CRITICAL NOTICE: WineFairy is a mobile service operating in environments provided by the Client. Because we do not control the premises, our liability is strictly limited as outlined below.

 

 


1. Nature of On-Demand Mobile Service

WineFairy provides professional wine education and tasting services at a location of the Client’s choosing (the “Premises”). The Client acknowledges that WineFairy is not responsible for the safety, suitability, or maintenance of the Premises.

 

 

2. Comprehensive Waiver of Liability

The Client expressly assumes all risks associated with hosting a tasting event and agrees to release WineFairy from any and all liability for:

 

 

  • Property Damage: Any damage to the Premises, including but not limited to spills, stains on flooring or furniture, broken glassware, or any issues arising from the setup and breakdown of tasting equipment.

     

     

  • Personal Injury: Any injury sustained by the Client or their guests on the Premises, including but not limited to slips, falls, or reactions to products consumed.

     

     

  • Third-Party Incidents: Any damage or injury caused by guests to third parties during or after the event.

     

     

3. Alcohol Responsibility & Legal Compliance

  • Age Verification: All participants must be of legal drinking age. WineFairy reserves the right to verify IDs and refuse service to minors.

     

     

  • Sober Transportation: The Client is solely responsible for ensuring that all guests have safe and legal transportation from the Premises following the event. WineFairy is not liable for any intoxicated driving incidents.

     

     

  • Right to Cease Service: WineFairy staff may, at their sole discretion, stop serving any individual who appears visibly intoxicated or whose behavior is deemed unsafe.

     

     

4. Indemnification

The Client agrees to indemnify, defend, and hold harmless WineFairy and its agents from any claims, damages, costs, or expenses (including reasonable attorney fees) arising out of or related to the event, including but not limited to the conduct of guests or any hazards present at the Client’s Premises.

 

 

5. Service Environment & Safety

The Client must provide a clean, safe, and professional environment for the WineFairy representative. We reserve the right to vacate the Premises immediately without refund if our staff feels unsafe, harassed, or if illegal activities are occurring.

 

 

6. Allergic Reactions & Dietary Restrictions

While WineFairy may provide tasting notes and pairing suggestions, participants are responsible for managing their own allergies. WineFairy is not liable for allergic reactions to wine, sulfites, or provided snacks.

 

 

7. Cancellations & Equipment

  • Cancellations: Cancellations within 48 hours of the scheduled event may result in a forfeiture of the deposit.

     

     

  • Equipment Damage: Any damage to WineFairy’s professional tasting kits or glassware caused by the Client or guests will be billed to the Client at full replacement cost.
